California's workers' compensation system was established in 1913 by the Boynton Act, which granted specific rights and benefits to injured workers. All workers covered by workers' compensation insurance have the right to:

  • Medical care for treatment of on-the-job injuries or occupational illnesses at no cost. Treatment must be provided by a medical professional approved by the employer. After 30 days, you may change doctors and be treated by your own physician in some circumstances. This right is only available to workers with employer-provided group health insurance who, before the date of injury, had designated their preferred doctor in writing.
  • Freedom from punishment or firing because you filed a workers' compensation claim or testified in a co-workers' workers' comp case.
  • Challenge denial of benefits and information in medical reports through an appeals process.
