Temporary Disability Payments

San Jose Lawyers: Temporary Disability Payments

If you are injured on the job and can't return to work for more than three days, you may be entitled to receive temporary disability (TD) payments through your employer's workers' compensation insurance.

Know Your Rights—Call 1-800-662-9807

There are two types of temporary disability: total temporary disability, for those unable to do any work at all, and temporary partial disability, for those who can still do some sort of work after an injury.

In general, temporary disability covers two thirds of your pretax weekly wages up to a limit of $881.66 for injuries that occurred in 2007. The minimum temporary disability payment is $132.25. The maximum and minimum payments are based on the state average weekly wage and change each year.

A Complicated Calculation

Temporary disability can become complicated, especially if you work more than one job, do seasonal work, have irregular income, were scheduled for a wage increase after the date of the injury, or received tips, meals, bonuses, a car allowance or other types of non-wage income.

At the Boccardo Law Firm, we help clients receive the full amount of temporary disability payments they deserve. Some clients come to us because they are unsure if the payments they are receiving are accurate. Others call us when the payments stop unexpectedly or are unreasonably delayed.
